How the Dominican Christmas salary works

Quick answer: the regalía pascual, or salario de Navidad, is one twelfth of the ordinary salary you earned from January 1 to December 31 (Labor Code art. 219). A full year at RD$35,000 a month gives RD$35,000; starting April 1 at RD$30,000 gives 9 × 30,000 ÷ 12 = RD$22,500. It is due by December 20 — a Sunday in 2026 — whether you are still employed or left during the year, for any reason (art. 220).

Always divide by 12, never by the months worked; if your pay changed, the result is the average, not your latest salary. Regular commissions count; overtime, profit sharing and tips do not. The law caps the obligation at five minimum wages (RD$149,940 at a large company in 2026), though employers may pay more. The Christmas salary is free of income tax and of AFP and SFS contributions, so you receive it in full. Everything runs in your browser — your salary is never sent anywhere.

FAQ

How is the Dominican Christmas salary calculated?

Add up all ordinary salary earned from January 1 to December 31 and divide by 12 (Labor Code art. 219). A full year on a fixed salary means one extra month’s pay; if your pay changed, you get the average, not your latest salary. Overtime, profit sharing (bonificación) and tips are left out.

Do I get it if I quit, was fired, or only worked a few months?

Yes. Anyone who did not work the whole year gets the share for the time worked, whatever the reason the job ended (art. 220). There is no minimum: 3 months at RD$20,000 is RD$5,000 (60,000 ÷ 12). When the contract ends, the employer must give you a written statement of the amount (art. 221).

Is it taxed or subject to AFP or SFS?

No. The Christmas salary is exempt from income tax (art. 222 and Law 204-97) and is not part of the salary used for social-security (TSS) contributions. It cannot be garnished or used to collect debts. Only an amount above the one-twelfth would be taxable income.
